What does it do?
- This ordinance amends the Constitutional Council (Functions, Duties, Powers and Procedures) Act, 2066. The Constitutional Council recommends appointments to constitutional bodies. The ordinance was issued by the President on the Council of Ministers' recommendation under Article 114(1) of the Constitution because the Federal Parliament was not in session. It changes only Section 6 of the Act, on the Council's meetings. Nepal Law Commission (lawcommission.gov.np), official text Preamble and Sections 1–2, PDF p. 1
- It removes Section 6(6) and replaces Section 6(7). If a Council meeting lacks a quorum or cannot reach a decision, the chair must call another meeting with at least 24 hours' notice. A new Section 6(7a) says that at that second meeting, a quorum exists if the chair and a majority of the members then in office are present. Decisions can then be made by a majority of the members present, including the chair. Nepal Law Commission (lawcommission.gov.np), official text Section 2 (amending Act s. 6), PDF p. 1
- Under Article 114 of the Constitution, an ordinance has the same force as an Act. But it must be tabled in both Houses when they next meet. It lapses if both Houses do not accept it, it can be repealed by the President at any time, and in any case it lapses 60 days after both Houses meet. Nepal Law Commission Article 114(2), PDF p. 58
