What does it do?

  • This ordinance amends five laws to deal with acid attacks: the Evidence Act 2031, Administration of Justice Act 2073, Muluki Criminal Code 2074, Muluki Criminal Procedure Code 2074 and Criminal Offences (Sentencing and Execution) Act 2074. Under the Evidence Act, when someone throws, sprays, pours or otherwise uses acid on another person's body or makes them consume it, the court will presume the act was done intentionally or knowingly to kill or maim; under the Administration of Justice Act, courts must give first priority to cases of killing, maiming or injury by acid whenever they are filed. Nepal Law Commission Sections 2–3, PDF p. 1
  • A new section 192A of the Muluki Criminal Code makes maiming or injuring someone with acid a specific offence: twenty years' imprisonment and a Rs 1,000,000 fine where the victim completely loses sight in both eyes or hearing in both ears, the face is fully disfigured or other listed injuries occur; fifteen to twenty years and Rs 700,000–1,000,000 for other serious listed injuries; seven to ten years and Rs 500,000–700,000 for other injuries; and five to seven years and Rs 100,000–300,000 for an attempt. The whole fine goes to the victim as compensation, and death within a year counts as murder. Nepal Law Commission Section 4(4) (new s. 192A), PDF pp. 2–4
  • It also bans collecting money in a victim's name: asking for or taking donations or aid by publicising that a person is a crime victim (with or without photos or social media appeals) is punishable by up to three months' imprisonment or a fine of up to Rs 5,000, with the money seized, though help from governments or freely given help is allowed. Acid offences are added to the procedural and sentencing laws, and section 48 of the Sentencing Act now also covers medical treatment and interim compensation for victims. Nepal Law Commission Section 4(3) (new s. 126A), PDF p. 2; Sections 5–6, PDF pp. 4–5
  • Under Article 114 of the Constitution, an ordinance has the same force as an Act, but it must be tabled at the next session of both Houses; it ceases to have effect if both Houses do not adopt it, if the President repeals it, or sixty days after both Houses meet. The House of Representatives' ordinance-status list records an entry for this ordinance (registered 2077-11-18) as having become inactive automatically after sixty days from the start of the session. Nepal Law Commission · Federal Parliament of Nepal Article 114(1)–(2), PDF p. 62; HoR ordinance-status entry
