Public Procurement (Second Amendment) Act, 2083 BS

What does it do?

• This Act makes wide changes to the Public Procurement Act, 2063 (38 sections). Public bodies may not start procurement without a budget allocation (for multi-year contracts, the first year's budget plus a secured source for later years), and may not invite bids for construction until the site is available, trees and structures can be cleared, compensation funds are secured and any required environmental study is approved. • Mobilisation advances of up to 20% of the contract amount may be given against an advance bank guarantee, after the public body obtains the main activities and work schedule. • For projects of national pride, transformative projects and others the government designates, staff may receive incentives and bonuses, and contractors awards, bonuses or letters of appreciation, when work is finished to quality standards ahead of the original deadline.
