What does it do?
- This is the annual law that authorises the Government of Nepal to borrow at home to carry out its budget for fiscal year 2082/83. It took effect on 1 Shrawan 2082 (the start of the fiscal year) and is passed alongside the budget each year. Nepal Law Commission, Government of Nepal Preamble and Section 1, p. 1
- The government may raise national debt of up to Rs 362 billion on top of the outstanding overdraft and other outstanding amounts at the end of fiscal year 2082/83. Overdraft the government may take from Nepal Rastra Bank under other laws does not count towards this limit. Nepal Law Commission, Government of Nepal Section 2(1), p. 1
- The government may allow Nepal Rastra Bank to convert the outstanding overdraft up to 2082/83 into treasury bills. The repayment period of the debt raised under this Act and its interest rate are governed by the Public Debt Management Act 2079, under which the Public Debt Management Office manages borrowing. Nepal Law Commission, Government of Nepal Section 2(2)–(3), p. 2
Gaps, loopholes and improvement ideas
- Capacity The government has been borrowing while money it transferred to provinces and local governments sits unspent. The Financial Procedures and Fiscal Responsibility Regulation requires the Ministry of Finance to prepare a cash plan, but the Auditor General found none was prepared. In 2081/82 the government took Rs 329.08 billion in domestic loans and Rs 126.95 billion in foreign loans, while Rs 132.45 billion transferred (partly from borrowed money) lay unspent at provincial and local level, costing about Rs 5.07 billion a year in extra interest. The previous year it reported Rs 149.26 billion unspent and Rs 7.87 billion of interest. These findings concern the borrowing authorised by the previous years' equivalent Acts. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd Annual Report, chapter 3 (summary of main findings), para 10, printed p. 17 (PDF p. 47); OAG 62nd Annual Report, chapter 3, para 23, printed p. 23 (PDF p. 51)
Ideas to fix it
- Mobilise loans in productive sectors, and consider financial instruments that can manage the exchange-rate risk on foreign-currency debt, which added Rs 65.54 billion to the debt burden in 2081/82 alone. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
