What does it do?

  • This is the annual Finance Act that puts into effect the government's revenue proposals for FY 2082/83. It confirms that VAT, excise and customs duties are levied under their own Acts, and it amends the Liquor Act 2031, the Value Added Tax Act 2052, the Excise Act 2058, the Income Tax Act 2058 and the Customs Act (cited in the text as the Customs Act, 2081); those amendments are deemed to be amendments of the parent Acts. Most of its other levies, waivers and special provisions apply only until the end of Asar 2083 unless a federal Act says otherwise. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble and Sections 1–4, p. 1; Sections 34–38, pp. 11–172; Sections 39–40, p. 269
  • It imposes a range of fees and taxes for the year, including: a 1 percent foreign employment service fee on what licensed agencies collect from migrant workers (administered by the Department of Foreign Employment); a 3 percent education service fee on foreign exchange for study abroad; infrastructure, road construction, road maintenance (Rs 4 per litre on petrol, Rs 2 on diesel) and pollution control (Rs 1.50 per litre) levies on fuel and vehicles; a green tax on listed imports; telecom service charges and a 2 percent telephone ownership fee on mobile SIMs and recharges; casino royalties of Rs 50 million a year (Rs 15 million for machine-only games); and a luxury fee and a health-risk tax on goods listed in the schedules. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 5–15, 17 and 20, pp. 1–7; Schedules 1–6, pp. 270–300
  • Non-resident companies selling digital services to users in Nepal, or selling data collected from Nepali users, must pay a 2 percent digital service tax on the transaction value, filed online with the Inland Revenue Department within three months of the fiscal year's end; sales up to Rs 3 million a year and business-to-business sales are exempt, and income taxed this way is not also subject to income tax. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 16, pp. 4–5
  • Notwithstanding other laws, the government may raise, lower or wholly or partly waive any fee, duty or tax imposed under this or other Acts. The Act also grants time-bound amnesties — for example, waiver of penalties, extra fees and remaining interest for VAT registrants who pay outstanding returns, tax and 25 percent of the interest by the end of Pus 2082, and waivers for community hospitals and transport associations and for old vehicles being deregistered — and lets hydropower projects import equipment against bank guarantees. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 18, 21, 24–25, 31, pp. 5–10

Gaps, loopholes and improvement ideas

  • Unclear The High-Level Economic Reform Suggestion Commission (2081) found that because the annual Finance Act does not respect the tax concessions and other provisions granted by sectoral laws, and because tax rules are amended repeatedly, uncertainty about taxes has been created; it notes that stable rates give investors certainty. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance · Nepal Law Commission (lawcommission.gov.np), consolidated official text HLERC report, revenue chapter, para 26, PDF p. 170 (printed p. 103); Act Section 18, p. 5

Ideas to fix it

  • The Commission recommends that the Finance Act automatically adopt the tax facilities set by sectoral laws. Proposed by: High-Level Economic Reform Suggestion Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
  • In a submission annexed to the Commission's report, the Federation of Nepalese Chambers of Commerce and Industry (FNCCI) proposes ending the practice of an annual Finance Act changing revenue laws, which it says has been used for frequent policy changes and retroactive measures, and replacing it with a unified revenue code passed by Parliament. Proposed by: FNCCI (submission in Annex 1 of the HLERC report) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
