Act Amending Some Nepal Acts on Promoting Good Governance and Public Service Delivery, 2081 BS

What does it do?

• This omnibus Act amends twelve laws: the Non-Resident Nepali Act, 2064; the Good Governance (Management and Operation) Act, 2064; the Domestic Violence (Offence and Punishment) Act, 2066; the Proceeds of Crime (Freezing, Control and Confiscation) Act, 2070; the Labour Act, 2074; the Local Government Operation Act, 2074; the National Criminal Procedure Code, 2074; the Health Insurance Act, 2074; the Social Security Act, 2075; the Crime Victim Protection Act, 2075; the Pension Fund Act, 2075; and the Yogmaya Ayurveda University Act, 2079. • Under the Good Governance Act, officials must decide matters within seven working days of receiving the needed information or documents, and supervisors up to the Chief Secretary can formally warn those who delay or avoid decisions, with warnings counted in performance appraisals. Matters the law reserves to the 'Government of Nepal' (other than Cabinet matters and appeals to the government) count as done by the government when decided by the minister or a delegated special-class officer. • In criminal procedure, cases involving cheque-bounce banking offences, criminal breach of trust or criminal gain can be settled by agreement at any stage, including during enforcement of a judgment, which cancels the recorded penalty; a first-time offender sentenced to one year or less can pay money instead of serving prison time; and the government may make a national identity number mandatory for social security allowances in notified areas.
