What does it do?
- This Act amends the Privatisation Act, 2050 and renames it the Public Enterprises (Government Investment) Management Act. Throughout the Act, 'privatisation of enterprises' becomes 'management of government investment in enterprises'. - It adds an Implementation Committee led by the Finance Secretary, with joint secretaries from the law ministry, the finance ministry's corporate-coordination division and the line ministry, plus the enterprise's chief executive, meeting at least every two months to carry out, monitor and evaluate decisions on government investment. - Methods now include share disinvestment (with priority to the public, workers and employees where possible) and monetising an enterprise's assets. Leasing assets or management contracts need the committee's agreement in principle and government approval before proposals are invited. - The maximum fine for obstructing the process rises from Rs 5,000 to Rs 1 lakh (imprisonment of up to two months stays), and the person must first be given a fair chance to defend themselves.
