What does it do?

  • This is an annual Act passed with the budget. It authorises the Government of Nepal to raise domestic public debt ('national debt') to carry out its financial proposals for fiscal year 2081/82 only (in force from 1 Shrawan 2081). Parliament passes a new Act of this kind each year; the 2082 and 2083 versions cover later fiscal years. Nepal Law Commission, Government of Nepal Preamble and Section 1, p. 1
  • On top of the outstanding overdraft and other outstanding amounts at the end of FY 2081/82, the government may raise up to Rs 330 billion (3 kharab 30 arab) in national debt. This ceiling does not include overdrafts the government may take under other laws. Nepal Law Commission, Government of Nepal Section 2(1) and proviso, p. 1
  • The government may authorise Nepal Rastra Bank to convert the government's outstanding overdraft up to FY 2081/82 into treasury bills. The repayment period and interest rate of debt raised under this Act follow the Public Debt Management Act, 2079. Nepal Law Commission, Government of Nepal Section 2(2)–(3), p. 1

Gaps, loopholes and improvement ideas

  • Capacity Borrowing without a cash plan. The Auditor General reported that in FY 2081/82 the government raised Rs 329.08 billion in domestic debt (just under the Rs 330 billion ceiling in section 2) and Rs 126.95 billion in foreign loans. The Ministry of Finance had not prepared the cash plan required by Rule 29 of the Financial Procedures and Fiscal Responsibility Regulations, 2077. Part of the borrowed money was transferred to provinces and local governments, where Rs 132.45 billion lay unspent in their treasuries. The Auditor General estimated that this cost about Rs 5.07 billion a year in extra interest, at the average domestic-debt rate of 3.87 per cent. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Annual Report, chapter 3 (summary of main findings), para 10 'Cash plan', printed p. 17 (PDF p. 47); Act s. 2(1), p. 1
