What does it do?

  • The Legislation Act sets how federal bills and ordinances are prepared, to make law-making more transparent, participatory and good quality. Ministries must set legislative priorities in line with Government policy, get in-principle approval before drafting a law on a new subject, involve experts and directly affected stakeholders, publish the draft and an explanation of the problem it addresses on their website for 7 to 30 days for public comment, discuss it in the relevant thematic committee, consult other bodies, and obtain the Law Ministry's drafting consent before Cabinet approval and registration in Parliament. Ordinances under Article 114 follow a set process. Nepal Law Commission Sections 3–12, pp. 2–6
  • Delegated legislation (rules, regulations, directives, procedures, standards and orders) may be issued only where an Act delegates the power, may not go beyond the Act's purpose or the powers given, and may not encroach on the constitutional powers of the federation, provinces or local levels. Unless the parent Act provides otherwise, it may not set up or run funds, create charges on the Consolidated Fund, define offences or set penalties, levy or change taxes, or create judicial or quasi-judicial bodies. The Act also says which matters belong in rules, regulations, directives, procedures and standards, and which need Law Ministry consent and Cabinet approval. Nepal Law Commission Sections 13–22, pp. 6–9
  • Acts, ordinances and delegated legislation must be recorded, registered and published in the Gazette and on official websites; delegated legislation that has not been published has no legal force and does not apply to the public. Ministries send records to the Law Ministry, which keeps a consolidated register, and copies go to the parliamentary committee, which may regularly scrutinise delegated legislation and give directions or call attention to problems. Nepal Law Commission Sections 23–35, pp. 10–15
  • Every ministry must evaluate how each Act it is responsible for is being implemented within a year after the Act's fifth anniversary, and every five years after that, and submit the report to the Federal Parliament. Nepal Law Commission Section 36, p. 15
