What does it do?
- The Act regulates the online sale of goods and services to make it orderly and trustworthy. It applies across Nepal and also to sellers based abroad who sell to people in Nepal online. Only firms, companies and organisations registered and permitted under other laws to trade may do e-commerce, and each must run its own electronic platform showing its name, address, registration, VAT or PAN number, contact and grievance-handling details. Nepal Law Commission, Government of Nepal Sections 1–4, pp. 1–4
- Every e-commerce business must list on the electronic commerce portal of the Department of Commerce, Supplies and Consumer Protection (existing businesses within three months of the Act starting), and the Department must confirm listing within seven days. Businesses must disclose product and service details and prices, an order forms a contract, and the Act sets rules on payment, delivery, returns, privacy of personal data and banned sales. Nepal Law Commission, Government of Nepal Sections 5–13, pp. 4–9
- Intermediary platforms, list-based sellers, sellers, buyers and delivery providers each have duties, and a platform cannot escape responsibility for a complaint just because it did not make or supply the product. Inspection officers may fine violators Rs 20,000–100,000, with appeal to the Director General; more serious offences carry Rs 50,000–500,000 fine or six months to three years' prison, prosecuted by the government in the consumer court or district court. The Department monitors and inspects, receives complaints, and consumer protection law also applies. Nepal Law Commission, Government of Nepal Sections 14–31, pp. 9–16
Gaps, loopholes and improvement ideas
- Not enforced Foreign online sellers are hard to regulate in practice. The Auditor General found that because there is no separate business code for domestic transactions through local, foreign and international e-commerce sites, monitoring is difficult, and because foreign sites selling into Nepal are not registered in Nepal, their trade could not be regulated, so price and quality oversight was not effective; it asked the Department to strengthen monitoring. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Report, chapter 3 summary, para 64, printed p. 36; Act ss. 1(3) and 5, pp. 1, 4
