What does it do?
- Every good exported from or imported into Nepal is subject to customs duty under this Act. Goods are classified using the World Customs Organization's Harmonized System (headings and eight-digit subheadings, following the general interpretative rules in Schedule 1); the government may change subheadings by Gazette notice but not in a way that changes the duty owed. Export duties apply only to goods listed in Schedule 2, and import duties are charged at the rates in Schedule 3 (goods marked 'माफी' are duty-free), with special rates and exemptions in Schedule 4 and rules for temporary imports in Schedule 5. Nepal Law Commission, Government of Nepal Sections 3–7, pp. 3–5
- An agricultural reform fee applies to listed goods imported overland from India or Tibet (China). Import charges are calculated in sequence: customs duty on the customs value, then excise on value plus duty, then other levies, and finally VAT on the total; demurrage and fines are excluded from the VAT base. Duty concessions under treaties, diplomatic privileges, bank-guaranteed or cash-deposit imports of raw materials and facilities for industries in special economic zones are provided for. Nepal Law Commission, Government of Nepal Sections 8–16, pp. 5–12
- The Act also covers the customs service fee, the rule that only one exemption or facility may be claimed, who must pay duty and fines, demurrage, recovery of wrongly exempted duty, refunds, the date that fixes the applicable rate, and temporary exports. Customs duty is governed by this Act, but each year's Financial Act may still impose, raise, cut or waive duties; customs officers' decisions can be reviewed and appealed, and the Director General of Customs may resolve ambiguities in the schedules. Nepal Law Commission, Government of Nepal Sections 17–29, pp. 13–19
Gaps, loopholes and improvement ideas
- Loophole Exemptions under Schedule 4 are large and in places applied beyond what the Act allows. In FY 2081/82 customs duty of Rs 85.23 billion was waived (Rs 79.87 billion the year before). Schedule 4 section 6(2) allows 1% duty on construction equipment and machinery for hydropower and transmission-line projects, yet nine customs offices also gave this rate on pipes, steel and aluminium structures and other construction materials outside HS chapters 84–85, waiving Rs 1.42 billion, and concessions were also given on goods for Nepal Electricity Authority distribution and routine substation maintenance not covered by the provision. The Auditor General asked for the amounts to be settled and recovered. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Report, Ministry of Finance chapter (Department of Customs), para 120–120.2, printed pp. 156–157; ch. 3 summary para 4, printed p. 14; Act s. 7(4), p. 5
Ideas to fix it
- Settle and recover duty wrongly exempted on construction materials and non-qualifying electricity goods, and grant exemptions only for goods that clearly meet the Schedule's criteria. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
