What does it do?

  • The Appropriation Act authorises spending from the federal Consolidated Fund for FY 2081/82, apart from charges listed in Schedule 1: a total of up to Rs 1,457.05 billion (Rs 14 kharab 57 arab 4 crore 96 lakh) for recurrent spending, capital spending and financing, allocated to the bodies listed in Schedule 2. Authorised officials may spend it from the day the Act starts, and the Financial Comptroller offices release funds on that basis. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 2–4, PDF pp. 1–2
  • The Ministry of Finance may move money between budget heads (virement) only up to 10% of the total appropriation, with limits: capital budget cannot be shifted to recurrent spending except to financing and debt service, and the fiscal equalisation grants for provinces and local governments (heads 701 and 801) cannot be moved elsewhere. Changes to projects in the budget information system need ministry consent within set time limits. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 5, PDF pp. 2–6
  • Grants under heads 701 and 801 are transferred to provincial and local consolidated funds; equalisation grants are paid in four instalments (Bhadra, Kartik, Magh and Baisakh) and the last two are adjusted against revenue performance. Provinces and local governments must spend their revenue and transfers under their own laws, follow federal economic policy, deposit all income in their consolidated funds, use grants only for their purpose and not shift capital budget to recurrent spending. An appropriation is not unlawful merely because some procedural step was incomplete. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 6, PDF pp. 6–8; Section 9, PDF pp. 12–14; Section 10, PDF p. 14

Gaps, loopholes and improvement ideas

  • Not enforced Some budget transfers exceeded the 10% virement ceiling in Section 5(2). The Auditor General's figures show budgets changed through virement far beyond 10% for several heads in FY 2081/82 — for example the Election Commission up 32.88%, bilateral foreign-loan repayment up 30.22%, the Ministry of Foreign Affairs up 19.25% and the Ministry of Education up 12.27%, while the Ministry of Youth and Sports was cut 41.25%. It said virement must stay within the legal limit. Office of the Auditor General, Nepal · Nepal Law Commission (lawcommission.gov.np), consolidated text OAG 63rd report, Ministry of Finance chapter, para 24.3 (PDF p. 140, printed p. 108); Act Section 5(2), PDF pp. 2–3
  • Unclear Section 7 lets provinces and local governments have federal offices carry out capital projects, with approval from the relevant federal ministry and the Ministry of Finance. The Auditor General found that in FY 2081/82 provinces gave 318 federal offices authority to spend Rs 387.9 million — including Rs 125.2 million of recurrent spending — without Ministry of Finance approval. It noted that the Intergovernmental Fiscal Arrangement Act, 2074 provides for four kinds of fiscal transfer but not for such cross-tier spending authority, which leaves federal offices answering to provincial rules and secretaries, and said the arrangement should be reviewed. Office of the Auditor General, Nepal · Nepal Law Commission (lawcommission.gov.np), consolidated text OAG 63rd report, Ministry of Finance chapter, para 25 (PDF p. 141, printed p. 109); Act Section 7, PDF pp. 8–11

Ideas to fix it

  • Review the inter-government spending-authority arrangement so that it has a clear legal basis and accountability. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
