What does it do?
- The Act requires every development policy, plan, programme and project of the federal, provincial and local governments to be monitored and evaluated regularly and periodically. It covers a wide range of 'public bodies': constitutional bodies, courts, ministries and departments, state-owned companies, banks and boards, universities and institutions run mainly on government grants, and bodies funded by government loans or grants. Monitoring must be judged against set bases such as periodic plans, results frameworks, approved programmes, cost-benefit, gender equality and inclusion, and Nepal's international commitments. Nepal Law Commission, Government of Nepal Section 2(छ), pp. 1–2; Sections 3–4, p. 3
- Responsibility is layered. The Office of the Prime Minister and Council of Ministers may monitor any government plan and must oversee whether others are monitoring properly. The National Planning Commission must monitor periodic and annual plans, national pride, national priority and transformative projects, foreign-aided projects and projects funded by grants to provinces and local levels. Ministries, departments and project chiefs monitor their own projects, and provinces and local levels monitor theirs. An independent third party with no interest in the project may be hired to monitor or evaluate. Nepal Law Commission, Government of Nepal Sections 9–15, pp. 7–9; Section 17, p. 11
- Implementing bodies must send two-monthly, four-monthly and annual progress reports upward, and ministries must send theirs to the Prime Minister's Office and the Planning Commission. Monitoring reports must be put on the body's website (within one month for findings received by the head of a public body) and discussed with stakeholders. Where a project is falling short and serious loss is likely, the monitoring body may stop the work, remove the responsible official or recommend other action, and following its directions is mandatory. Nepal Law Commission, Government of Nepal Section 16(3), p. 11; Sections 19–20, pp. 12–13
- A National Development Problem Solving Committee chaired by the Prime Minister, with federal ministers, provincial chief ministers and Planning Commission members, reviews development progress and solves policy problems; each ministry has its own problem-solving committee. Nepal Law Commission, Government of Nepal Sections 22–25, pp. 13–16
- Monitors must not take any benefit from the project they check, nor monitor a project they helped implement. Officials who fail to monitor or report on time, give false reports, withhold information or ignore directions face departmental punishment under their service law. Nepal Law Commission, Government of Nepal Section 30, p. 18; Section 33, pp. 18–19
Gaps, loopholes and improvement ideas
- Not enforced Decisions of the National Development Problem Solving Committee set up under the Act are not yet consistently followed through. The Auditor General found that the 10 decisions of its 51st meeting and 13 of its 52nd meeting (FY 2080/81), and the 15 decisions of its 53rd meeting (FY 2081/82), were sent to the ministries concerned, but the ministries had not prepared implementation reports on them. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd Report, National Planning Commission, para 5, printed p. 614; OAG 63rd Report, National Planning Commission, para 4, printed p. 565
- Not enforced Section 10 requires the Planning Commission to monitor national priority projects (at least twice a year, as the Auditor General reads it). There were 268 such projects, but no annual progress report on them had been prepared in FY 2080/81. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 62nd Report, National Planning Commission, para 10, printed p. 616; Act s. 10, p. 7
