What does it do?
- Anyone appointed, elected or nominated to a public office who must take an oath under the Constitution or another law must take the oath of office and secrecy, before taking up duties, from the official named in that law. Where the law requires an oath but gives no wording, or requires no oath at all, the person takes the oath in the form set out in the Act's Schedule (in the latter case before an official named by the government). Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 2–3, pp. 1–2; Schedule, p. 4
- The oath is taken in Nepali, the official language, but a person may take it in their own mother tongue spoken in Nepal by submitting a self-certified translation in advance. The person may wear the formal dress set by the government or dress reflecting their own culture and identity, and may choose to swear 'in the name of God' or 'in the name of the country and people'. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 4–5, p. 2; Schedule note, p. 4
- The person takes office only after the oath; signed copies are kept by the swearing-in official's office and sent to the relevant body. Oaths taken before the Act came into force are treated as taken under it. The Act names no separate enforcement body. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 5(3), 6–8, p. 2
