What does it do?

  • Anyone who wants to produce, export, import or sell acid or another lethal chemical must hold a licence. The Ministry of Home Affairs issues licences for production, export and import; the Chief District Officer (or an officer they designate) issues licences for sale and distribution. A licence lasts five years and must be renewed at least 35 days before it expires. Every import needs separate prior approval, and for certain acids used by specified industries a licence may be given only to that industry, only for the quantity it needs. Nepal Law Commission Sections 3–6, pp. 2–4; Section 14, p. 10
  • Licence holders may not sell or give acid or lethal chemicals to anyone under 18, and may ask buyers for proof of age. Products must be sold only in sealed original packaging, kept out of easy reach of buyers at the point of sale, and every sale must be recorded. Packages must carry warning messages and hazard symbols. Industries, firms or people who buy these chemicals must get the Chief District Officer's prior approval stating the quantity, method, place and time of use, store them safely, use them only for the stated purpose and keep a record of quantities used; failing to keep that record can bring a fine of up to Rs 10,000. Nepal Law Commission Sections 9 and 11–13, pp. 7–10
  • A Central Acid and Other Lethal Chemicals Control Committee, chaired by a Joint Secretary of the Ministry of Home Affairs and including technical representatives of the industry and forest/environment ministries and three chemistry experts (at least one a woman), oversees control. Each district has a committee led by the Chief District Officer, with police, Nepali Army and revenue office representatives, which inspects and monitors licence holders and arranges safe destruction of chemicals. The ministry may set up an online electronic register in which licence holders must enter production, import, storage, transport and sales data. Disposal must not harm people, animals or the environment. Nepal Law Commission Section 15, p. 11; Sections 16 and 19–21, pp. 11–14
  • Producing, importing, exporting or selling without a licence is punishable by a fine of Rs 50,000–100,000 and three months to one year in prison; breaching licence conditions carries a fine of Rs 10,000–50,000 or up to one month in prison or both; missing warning labels Rs 50,000–100,000 or up to three months or both; and breaking the sale, display or disposal rules a fine of Rs 10,000–40,000. Seized chemicals can be confiscated. Anyone whose breach of the Act causes injury, death or property loss must pay compensation, which the Chief District Officer orders on the victim's complaint. Customs officers hear import/export cases and the Chief District Officer hears the rest; appeals go to the District Court within 35 days, and the Government of Nepal is the plaintiff. Prosecution under other laws (for example for an acid attack) is not barred. Nepal Law Commission Sections 23–31, pp. 14–16
