What does it do?
- The Act (the Radioactive Materials (Use and Regulation) Act) provides for the safe and peaceful use of radioactive materials and technology, research, and protection of people and the environment from ionising radiation. Radioactive sources may be used only for human welfare and development. A regulatory body including public health, legal and other experts is to be set up under the ministry (the ministry does its work until it is established), with a steering committee on radioactive and nuclear matters; radioactive material found in Nepal belongs to the government. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 3–8, pp. 1–8; Section 55, p. 28
- No one may carry out any practice or activity with radioactive sources without a licence from the regulatory body; licences are non-transferable, time-limited and can be amended, suspended or cancelled, and licensees must meet safety duties and get prior approval for changes. The regulator keeps a register of sources, sets radiation-protection standards, manages orphan sources, and must approve permanently shutting down or decommissioning equipment; licensees bear the cost of managing the resulting waste. Radioactive waste may be exported only with permission to countries with adequate regulation, imports of radioactive waste are barred, and transport, import and export of sources need approval. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 9–31, pp. 8–17; Sections 35–38, 44, pp. 19–22
- The government must prepare radiation emergency plans; production of radiological weapons or explosive devices is prohibited, and theft or loss of material must be reported. Offences carry heavy penalties — for example confiscation and fines of Rs 700,000–1,200,000 with 5–10 years' prison for certain offences, and life imprisonment if someone dies — plus double compensation for actual loss; the government prosecutes, and there is no time limit where a death occurs. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 32–33, 41, 46–53, pp. 18–27
