What does it do?
- The Act gives Nepal trade-remedy tools to protect domestic industry from harmful imports. If imports of a product surge unexpectedly and threaten serious injury to Nepali producers of a similar or competing product, the government may impose safeguard measures: an extra duty on top of normal customs duty, a tariff-rate quota, full or partial quantitative restrictions, or other prescribed measures. Safeguards last up to four years, can be extended, and may be imposed provisionally during an investigation. Nepal Law Commission Sections 3–7, pp. 4–6
- Dumping — exporting goods to Nepal below their normal value — is prohibited. Where dumping causes or threatens material injury to domestic industry, the government may impose anti-dumping duty for up to five years (extendable), or a time-limited provisional duty once an investigation has run at least 60 days; it is not imposed if the dumping margin is below 2% or a country's share of imports is small (3%), unless several such countries together exceed 7%. Similarly, countervailing duty may be imposed on subsidised imports, except where the subsidy is below 2% (developing countries) or 1% (others). Nepal Law Commission Sections 8–12, pp. 6–8; Sections 13–16, pp. 8–10
- Domestic producers (or their representatives) may petition the department designated by the Ministry of Industry, Commerce and Supplies; an investigation officer of at least gazetted second class examines the petition, publicises the investigation, hears the other side, and prepares preliminary and final reports, on which the government decides. Investigations may be suspended or dropped, for example if exporters agree to raise prices. Only one of these remedies may be imposed on the same goods, duties are collected by customs, excess duty must be refunded, and measures must be reviewed and limited to what is necessary. Nepal Law Commission Section 2(dha), p. 3; Sections 17–26, pp. 10–15; Section 32, pp. 17–18; Sections 38–43, pp. 20–22
- A coordination committee chaired by the Ministry's secretary, with Finance and Law ministry officials, the Director General of Customs and the heads of the FNCCI, CNI and Nepal Chamber of Commerce, coordinates implementation. Decisions imposing measures can be appealed to the commercial bench of the High Court with a deposit equal to the duty. The government may exempt goods used only in special economic zones or export processing zones, and the Ministry must review the Act's effects five years after it took effect. Nepal Law Commission Sections 33–36, pp. 18–19; Sections 44, 46, 48, p. 22
