Police Personnel Adjustment Act, 2076 BS

What does it do?

• The Act sets out how police personnel serving in Nepal Police when it came into force are to be adjusted (placed) into either Nepal Police or the provincial police forces created under the federal Constitution. It took effect on the eighth day after it was authenticated (2076/10/28).यो ऐन लागू हुँदा नेपाल प्रहरीमा कार्यरत प्रहरी कर्मचारीलाई सङ्घीय संविधानअनुसार बनेका नेपाल प्रहरी वा प्रदेश प्रहरीमा कसरी समायोजन (पदस्थापन) गर्ने भन्ने व्यवस्था गर्छ। यो प्रमाणीकरण (२०७६/१०/२८) भएको आठौँ दिनदेखि लागू भएको हो। Nepal Law Commission, Government of Nepal Preamble and Sections 1–2, p. 1
• First, the organisational structure and posts of Nepal Police and each provincial police force are fixed by the government on the recommendation of an Organisation and Management Survey Committee chaired by the Home Secretary, with the Inspector General of Police, joint secretaries from the Prime Minister's Office and the Finance and Law ministries, and the secretary of the relevant provincial ministry. • The Home Ministry publishes notices of the posts to be filled in each province, and police personnel up to the rank of Deputy Superintendent apply; personnel who do not apply can still be adjusted. Where there are more people than posts in Nepal Police, seniority in rank and age decide priority. Where provincial posts cannot be filled through adjustment, personnel can be deputed from a pool of posts kept in Nepal Police, with special rules for Senior Superintendents and Superintendents. • Personnel adjusted into a provincial force may compete for promotion to vacant provincial posts if they meet the minimum qualifications and service period. Provinces set service conditions within the standards in the Act, a provincial authority may impose the departmental punishments set by federal law, and when giving grants to provinces the federal government must take account of the extra costs caused by adjustment.
