What does it do?

  • The Act regulates pesticides — their production, synthesis, import, export, storage, sale, transport, use and disposal — to protect human and animal health and the environment. Every pesticide (including its active ingredient) must be registered with the Plant Quarantine and Pesticide Management Centre before any of these activities, and unregistered pesticides may not be handled at all. Registrations must be renewed and can be suspended or cancelled. Nepal Law Commission (lawcommission.gov.np), consolidated text Preamble and Sections 3–7, PDF pp. 1–5; Section 14, PDF p. 9
  • Producers, importers, exporters, transporters and packers need a three-year licence from the Centre, while sellers, storers, commercial users and spraying businesses need a licence from the provincial pesticide management committee under provincial law. A national Pesticide Management Committee chaired by the agriculture secretary advises on policy and, on the Centre's recommendation, can ban harmful pesticides; banned products must be published in the Nepal Gazette. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 8–13, PDF pp. 5–9; Section 22, PDF p. 12
  • Pesticides may not be used indiscriminately or sold with residues above the set limits; knowingly selling adulterated or substandard pesticides is banned, sellers must also stock protective clothing, and disposal must not harm people, animals or the environment. The government must build storage facilities in every province for seized and unusable pesticides. Inspectors investigate offences, which carry fines from Rs 5,000 up to Rs 200,000 and up to one year in prison depending on the offence; licence holders must compensate victims of accidents. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 18, 22–25, 29, PDF pp. 11–15; Sections 32–35, PDF pp. 16–17; Section 42, PDF p. 19
