What does it do?
- The Act gives effect to the constitutional right to housing. Every citizen has the right to suitable housing — to build and live in safe housing within legal standards, to be protected from life-threatening homelessness, and to have their religious, social and cultural identity respected where they live. Respecting, protecting and fulfilling this right is the duty of the federal, provincial and local governments, and no one may be discriminated against in access to housing. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 3–4, pp. 1–3
- People may be removed from their homes only for a public purpose under law, after consultation, adequate reasoned notice, proper identification, in the presence of an authorised official and not at night; owners must be given resettlement and compensation before removal, with special care for elderly, sick, disabled, pregnant and child occupants. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 5, p. 3
- Governments must progressively provide housing, as prescribed and within available resources, to citizens who own no house or land anywhere in Nepal and cannot arrange housing themselves, and to people permanently displaced by disasters, with concessional finance and priority for the very poor. Local governments must survey and identify eligible families and issue identity cards; applicants must self-declare that they have no land or house; temporary shelter must be provided after disasters. Public servants, people drawing salaries from companies or NGOs and similar groups are excluded, and housing cannot be given twice. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 7–17, pp. 4–8
- Disputes over use of provided housing go to the local judicial committee. Obtaining housing with false information is punishable by up to two years' prison or a Rs 500,000 fine or both; misusing it or using it for other purposes by up to one year or Rs 300,000; and officials who knowingly record or recommend false details by a Rs 100,000 fine plus departmental action. Housing can revert to the providing government in specified cases. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 24–26, pp. 9–10
Gaps, loopholes and improvement ideas
Ideas to fix it
- The High-Level Economic Reform Suggestion Commission recommends implementing (issuing) the Right to Housing Regulations so as to secure the government's facilitating role in identifying and managing the homeless and landless squatters and ensuring their housing — many of the Act's provisions depend on rules 'as prescribed'. Proposed by: High-Level Economic Reform Suggestion Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance · Nepal Law Commission (lawcommission.gov.np), consolidated official text
