Province Public Service Commission (Norms and Standards) Fixation Act, 2015

What does it do?

• This federal Act sets the bases and standards that each province must follow when its own law sets up the Provincial Public Service Commission under Article 244 of the Constitution. The commission recruits for provincial civil, police and other government services, provincial public bodies, local government services and local public bodies, to keep selection fair and merit-based.संविधानको धारा २४४ बमोजिम प्रत्येक प्रदेशले आफ्नो कानूनद्वारा प्रदेश लोक सेवा आयोग बनाउँदा पालना गर्नुपर्ने आधार र मापदण्ड यो सङ्घीय ऐनले तोक्छ। प्रदेश निजामती, प्रदेश प्रहरी, प्रदेश अन्य सरकारी सेवा, प्रदेशका संगठित संस्था, स्थानीय सरकारी सेवा र स्थानीय तहका संगठित संस्थाका पदमा स्वच्छ र योग्यतामा आधारित छनोटका लागि यो आयोगले काम गर्छ। Nepal Law Commission, Government of Nepal Preamble and Section 2, pp. 1–2
• Each commission has up to three members including the chair, at least one a woman. They are appointed by the Province Chief on the recommendation of a committee of the Chief Minister, the Speaker and the opposition leader in the Provincial Assembly, following proportional inclusion. Members need a master's degree, must not belong to a party when appointed, and serve one six-year term (chair at least 45, members 35 years old; at least one member with 20 years' government service). • Commissions must follow the principles, methods and standards of the federal Public Service Commission, which must publish them; acts contrary to them are void. Written exams are in the federal official language, with English or the province's official language also allowed. No permanent appointment in provincial or local services may be made without consulting the commission, which must also be consulted on service laws and on principles for appointment, promotion and discipline.
