What does it do?
- The Act creates a Pension Fund, an autonomous body run by a board, and moves government employees appointed permanently after it came into force onto a contributory pension system. It covers the civil service (including health and parliament service), the Nepal Army, Nepal Police, Armed Police Force and Nepal Special Service, and, from 1 Baisakh 2082, teachers (added by a 2081 amendment). Each month the employee's office deducts 6 per cent of salary and the government adds an equal amount, credited to the employee's individual account along with interest and a share of profit. Nepal Law Commission, Government of Nepal Sections 3–4, pp. 2–3; Section 9, pp. 5–6; Sections 10–11, p. 6; title page, p. 1
- An employee with 20 or more years of service gets a lifelong monthly pension of (years of service × last salary) ÷ 50, raised by 10 per cent every three years; on death the spouse receives half as a family pension, or minor children until 18 if there is no spouse. Someone who leaves before 20 years gets the whole balance of their individual account as a lump sum (paid to the nominee if they die), but an employee dismissed in a way that bars future government service gets back only their own deductions plus interest. Nepal Law Commission, Government of Nepal Sections 12–15, pp. 6–8
- The Fund also pays, from money the government provides each year in a separate account, the pensions and gratuities of employees and community-school teachers appointed under the old non-contributory system. It may invest in government bonds, treasury bills, bank deposits, government-guaranteed loans, up to 25 per cent of a bank's or company's shares or debentures, housing projects and other listed investments, but must always keep enough to pay at least three years of pensions. Nepal Law Commission, Government of Nepal Sections 5 and 16, pp. 3, 8; Section 18(1)–(2), pp. 8–9; Section 25, p. 14
- From the start of the Act, no federal, provincial or local government body, or institution owned or regularly funded by the government, may appoint staff on terms that create a pension or gratuity liability for the government; such staff may be brought into a contributory scheme through the Fund by law. The Ministry of Finance inspects and supervises the Fund and may give it directions, the Auditor General audits it, and it must publish an annual report by the end of Kartik. Until the Fund is set up, the government may designate another body to run it; the Auditor General's 63rd report records that the Employees Provident Fund manages the contributory pension fund under this Act. Nepal Law Commission, Government of Nepal · Office of the Auditor General, Nepal Act ss. 24 and 27–30, p. 14; s. 33, p. 15; OAG 63rd Annual Report, Ministry of Finance chapter, Employees Provident Fund introduction, printed p. 883 (PDF p. 933)
