What does it do?
- The Act gives effect to the National Dalit Commission set up under Article 255 of the Constitution. On top of its constitutional duties, the Commission reviews and monitors policies and programmes for Dalit communities, studies laws and recommends reforms to the government, runs awareness work against caste discrimination and untouchability, monitors Nepal's international treaty obligations, and recommends which surnames should be listed as Dalit. - Anyone who suffers caste discrimination, untouchability or a harmful social practice, or is denied Dalit rights, can complain to the Commission free of charge, in writing or orally, or someone can complain on their behalf. The Commission makes a preliminary inquiry and can immediately stop an act that harms Dalit rights. In a full inquiry it can summon people, demand documents and inspect sites. - The Commission does not prosecute. Where a case should be filed, it recommends prosecution to the relevant body within the limitation period and shares its evidence, and that body decides whether to prosecute. The Commission may mediate disputes that the law allows to be settled, and may dismiss baseless complaints. - The Commission has its central office in Kathmandu Valley and may open offices in the provinces. It deals with the government through the Ministry of Federal Affairs and General Administration. Gaps, loopholes and improvement ideas
- Not enforced Complaints are passed on rather than resolved, and the Commission's own annual report lists unfinished work. Under section 8 the Commission received 58 complaints in 2080/81 and 64 in 2081/82 (for example, 35 and 36 cases of caste-based untouchability, abuse and assault, and 5 killings each year), and in each case it forwarded them to other agencies for action. - Capacity Limited reach. In 2018 the UN Committee on the Elimination of Racial Discrimination said that, because of insufficient funding, the National Dalit Commission was operating only in Kathmandu. Section 16(2) allows provincial offices. Ideas to fix it
