What does it do?
- The Act establishes Nepal Open University as an autonomous corporate body to provide higher education, teaching and research through an open-learning system, so that more people can reach higher education. Its central office is to be at a place the government fixes by notice in the Nepal Gazette, and it may run programmes inside and, if needed, outside Nepal. Nepal Law Commission Preamble, p. 1; Sections 3–4, pp. 2–3
- The university is made up of an Assembly (Sabha), Executive Council, Academic Council, faculties, basic centres and study centres. The Executive Council, chaired by the Vice-Chancellor, is the executive body. Nepal Law Commission Sections 5 and 7, pp. 3–5; Section 9, p. 6; Section 10, pp. 6–7
- The Minister of Education, Science and Technology is the Chancellor and may inspect and direct the university. The government appoints the full-time Vice-Chancellor on the recommendation of a committee formed under Section 22; the Vice-Chancellor has general control over all university work and implements the Assembly's decisions. Nepal Law Commission Sections 17–18, pp. 10–11
- The university has its own fund made up of government and University Grants Commission money, donations, fees and foreign assistance; before receiving any money from a foreign person, government or international body it must obtain approval from the Ministry of Finance. Gaps, loopholes and improvement ideas
- Not enforced The university has taken foreign money without the approval Section 28(2) requires. The Auditor General reported that in 2080/81 it received Rs 22.378 million in grants (Rs 9.364 million from a Finnish university and Rs 13.014 million from Norad) without Ministry of Finance approval, and that in 2081/82 it again received Rs 6.644 million of foreign assistance without that approval. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd Annual Report, Ministry of Education chapter, para 49, printed p. 495 (PDF p. 525); OAG 63rd Annual Report, Ministry of Education chapter summary, printed p. 438 (PDF p. 470) and para 107, printed pp. 460–461; Act s. 28(2), p. 14
- Capacity Years after the Act, the university still has no building of its own. Section 3(2) places the central office where the government decides; a Cabinet decision chose Sanothimi, Bhaktapur, but the Auditor General found that construction had not started although Rs 120 million was budgeted in 2080/81 and Rs 1.05 billion in 2081/82, while the university paid Rs 5.937 million a year in rent for premises in Lalitpur. The Auditor General also found it spent only 12.39% of the Rs 850 million it had available in 2080/81 and did not prepare consolidated financial statements in the approved accounting format. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd Annual Report, Ministry of Education chapter, paras 47–48, printed pp. 494–495 (PDF pp. 524–525); OAG 63rd Annual Report, paras 105–106, printed p. 460 (PDF p. 492); Act s. 3(2), p. 2
Ideas to fix it
- Obtain foreign assistance only as the law requires (with Ministry of Finance approval), and build the central office as the Cabinet decided. Proposed by: Office of the Auditor General (62nd Annual Report) Office of the Auditor General, Nepal
