What does it do?

  • The Act sets up the Deposit and Credit Protection Fund, an autonomous body headquartered in the Kathmandu Valley, to protect deposits held in member institutions and loans those institutions make. Its authorised capital is Rs 10 billion and paid-up capital Rs 5 billion, mostly held by the Government. A board chaired by the Finance Ministry secretary (or a special-class officer the Government designates), with joint secretaries of the Finance and Law ministries, an NRB executive director, a banking expert, a chartered accountant and the Chief Executive Officer, runs it; the Government appoints the CEO under a performance agreement. Nepal Law Commission Sections 3–8, 49–50, pp. 3–6, 24–26
  • Banks and financial institutions licensed by Nepal Rastra Bank, and (since the 2081 amendment) cooperatives registered under cooperative law, must become insured members of the Fund, pay prescribed fees, an initial contribution and an annual premium, and give the Fund information, electronic deposit registers and financial statements; late payment attracts a penalty. Under Section 4, the Fund protects deposits under this Act only in NRB-licensed banks and financial institutions. Nepal Law Commission Sections 4, 14–28, pp. 4, 9–14
  • The Fund protects each individual depositor's deposits in an insured institution up to Rs 200,000, counting principal and accrued interest and combining all of that person's accounts in the same institution; the Government may change this limit by Gazette notice on the board's recommendation. If an institution fails or is liquidated, the Fund pays depositors through a set claims process, publishes notices for depositors it cannot find, and then recovers what it paid from the liquidation (with subrogation rights). Credit protection premiums and claims follow rules to be prescribed. Nepal Law Commission Sections 19–20, 29–37, pp. 10–18
  • The Fund keeps separate deposit-protection and credit-protection funds and a risk fund, invests its assets under set rules, and is audited annually. It may inspect member institutions, fine those that breach its requirements (with appeal), share information with Nepal Rastra Bank, and report to the Government every year; the Government may give it directions and may dissolve it. Nepal Law Commission Sections 38–48, 53, 56, 60, 63, pp. 18–30
