What does it do?

  • The Act implements the 1973 Convention on International Trade in Endangered Species (CITES), to which Nepal is party, by regulating and controlling trade in endangered wild animals and plants and their specimens. No one may buy, sell, keep, use, plant, breed, transport, export or import rare or endangered species or their specimens, except with a permit for purposes such as captive breeding, cultivation, production and trade, research, training, exhibition, conservation education or biodiversity conservation; people may grow endangered plants on their own private land. Nepal Law Commission, Government of Nepal Preamble; Section 3, pp. 1–4
  • Permits are issued after consulting the scientific authority and only where trade will not threaten the species' survival; exports need a certificate of origin and export permit, and trade only with countries party to the Convention. Endangered specimens already held must be registered and cannot be transferred without permission. The management authorities, the Department of National Parks and Wildlife Conservation (animals) and the Department of Forests and Soil Conservation (plants), monitor trade, cancel permits and report on the Convention; the scientific authorities are Tribhuvan University's Natural History Museum (animals) and the Department of Plant Resources (plants); a national coordination committee oversees implementation. Nepal Law Commission, Government of Nepal Sections 4–19, pp. 4–14; Section 31, p. 21
  • Penalties depend on the species: offences involving rare wild animals carry 5–15 years' prison or Rs 500,000–1,000,000 fine or both; endangered animals 2–10 years or Rs 100,000–500,000; protected animals and plants lighter terms, with accomplices punished like the main offender and helpers at half. Specimens, tools, weapons and vehicles used are confiscated. Investigations are carried out by protected-area and forest officers, who may detain suspects, and cases are heard by the designated court. Nepal Law Commission, Government of Nepal Sections 20–26, pp. 14–18
