What does it do?

  • The Act makes it a crime to accuse anyone of being a witch (boksi/boksa), or to abuse, humiliate, socially boycott or expel from home anyone accused, or their family. It is also a crime to make the accusation through a shaman (dhami-jhankri) or ritual, to beat, burn, brand or torture an accused person, to force them to eat excrement or to parade them, to maim them, to damage their property, or to call a gathering for any of these purposes. Attempting, inciting or helping is also an offence. Nepal Law Commission, Government of Nepal Sections 2–3, pp. 2–3
  • Anyone who learns of such an offence must tell the nearest police office, which must register the complaint and summon or arrest the accused within 24 hours. Police must arrange treatment, a medical examination and counselling for the victim, and provide security. A police officer of at least Assistant Sub-Inspector rank may enter and search premises and arrest without warrant where evidence might be lost, and women must be arrested by women police. Complaints must be filed within 90 days of the offence. The government is the plaintiff, and courts must keep the accused in custody where there are reasonable grounds. Nepal Law Commission, Government of Nepal Sections 4–8, pp. 3–5; Sections 16–17, p. 9
  • Penalties rise with the seriousness of the act: six months to two years' prison plus a fine for the accusation itself, up to five to eight years plus a fine of Rs 50,000–100,000 for torture and degrading treatment, and 10 per cent extra on the normal penalty for maiming. Repeat offenders get double. Guardians, and people holding public office, get 25 per cent more, with a ceiling of 15 years. Courts may issue interim protection orders for the victim, for example to let them stay in their home and to stop harassment. Nepal Law Commission, Government of Nepal Section 10, pp. 5–6; Section 11, pp. 6–7
  • The court must order the offender to pay the victim reasonable compensation and the full cost of treatment. If the offender cannot pay, the court may order the local government to pay compensation within 60 days, and treatment costs can be reimbursed from the Gender-Based Violence Elimination Fund. Police may place victims in service centres set up under the Domestic Violence Act. Federal, provincial and local governments must run awareness programmes, and hearings are held in closed court. Nepal Law Commission, Government of Nepal Sections 12–15, pp. 7–9; Section 18, p. 9
