What does it do?

  • The Act protects every employee and service user from sexual harassment at the workplace — government bodies, public enterprises, bodies set up by law and any registered business or organisation, including places used in the course of their work. Sexual harassment means, by abusing position or by pressure, influence, inducement or intimidation, touching with sexual intent, showing obscene material, making obscene remarks or gestures, proposing sexual activity, or teasing or harassing with sexual intent; genuine educational, research, medical or rescue acts are excluded. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 2(ग)–(घ), PDF pp. 1–2; Sections 3–4, PDF pp. 2–3
  • Managers must include anti-harassment provisions in service rules, raise awareness, take corrective steps, provide counselling to victims, keep a complaint box, and tell victims clearly how and where to complain. A victim (or anyone on their behalf) can complain to the manager within 15 days, and the manager must investigate at once; the victim can also complain directly to the Chief District Officer within 90 days, or if the manager does not resolve the complaint. Complainants must be protected from retaliation. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 5–7, PDF pp. 3–5; Section 9, PDF pp. 5–6
  • The Chief District Officer hears complaints (the Provincial Chief Secretary if the complaint is against a CDO) and may mediate. Harassment is punishable by up to six months in prison or a Rs 50,000 fine or both, plus compensation to the victim; managers who fail their duties or ignore directions can be fined up to Rs 25,000, penalties double for repeat offences, and a knowingly false complaint is fined up to Rs 10,000. Appeals go to the district court. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 8, 12–16, PDF pp. 5–9
