What does it do?

  • The Government of Nepal may extradite a fugitive accused or convicted person to a foreign state that requests it, under Section 3 — where there is an extradition treaty with that state and the offence is extraditable. Extraditable offences are those punishable by at least three years' imprisonment under Nepali law or the requesting state's law, tax, revenue, banking and similar financial offences even with lower penalties, and attempts, complicity or conspiracy to commit them. Nepal Law Commission Sections 3–4, pp. 1–2
  • Extradition must be refused if the offence is political, if the person is being or would be prosecuted or tried with prejudice because of caste, ethnicity, colour, religion, nationality or political opinion, if the offence carries or may carry the death penalty, if the person is a Nepali citizen, if it is a purely military offence, if there is a real risk of torture, or if a Nepali court has already decided the same offence. Certain serious crimes are not treated as political offences. Nepal Law Commission Sections 5–6, pp. 2–4
  • Requests come through diplomatic channels to the Ministry, which may proceed and seek an arrest warrant; the arrested person is brought before the District Court, which examines whether the request meets the Act's requirements and decides whether extradition is permissible, and the Government then extradites or informs the requesting state if it cannot. People not extradited because they are Nepali citizens are prosecuted in Nepal. Nepal may itself request extradition from other states, and the person sought gets legal aid; the requesting state bears the costs, and the person may not be re-extradited onward. Nepal Law Commission Sections 7–28, pp. 4–11
