What does it do?
- The Act sets up the Karnali Academy of Health Sciences, headquartered in Jumla, as an autonomous body. Its job is to bring health services within easy reach of people in backward areas, offer high-level health education and research, produce skilled health workers, and provide affordable, quality care. The former Karnali Zonal Hospital became the Academy's hospital. Nepal Law Commission, Government of Nepal Preamble, p. 1; Sections 3–4, p. 3; Section 6, pp. 3–4; Section 16, p. 11
- The Academy is made up of an Assembly (its highest body), an academic council, an executive council, a selection committee for teachers and staff, faculties, research centres, teaching institutions and the hospital. The Prime Minister is Chancellor and the health minister is Pro-Chancellor, who may inspect the Academy and give it directions. The Chancellor appoints the full-time Vice-Chancellor for four years on the recommendation of a committee chaired by the Pro-Chancellor; the Pro-Chancellor appoints the Rector, Registrar, deans and hospital director under procedures set by the executive council (provisions revised by a 2083 amendment). Nepal Law Commission, Government of Nepal Sections 5 and 7, pp. 3–4; Sections 18–24, pp. 11–12
- In every intake up to bachelor's level, 45 per cent of places are reserved for Nepali students who live permanently in backward areas and passed the SLC (or equivalent) from a community school there, with priority within that quota for women, Dalits, Adivasi/Janajati, Madhesi and other backward groups; selection is competitive. A share of master's places is reserved on similar lines, and people who have served for a set period in health facilities in backward areas get priority in admission. Nepal Law Commission, Government of Nepal Sections 32–33, pp. 14–15
- At least 20 per cent of each intake must get full scholarships for poor students recommended by their rural or urban municipality, and 45 per cent of those scholarships go only to women, Dalit, Adivasi/Janajati, Madhesi and backward-area students. Students who study under a reserved place, priority admission or scholarship must work in a backward area for the period the Academy sets, and only receive their permanent degree certificate after completing it. Nepal Law Commission, Government of Nepal Sections 34–35, pp. 15–16
- The Academy has its own fund (government grants, fees, grants or loans — foreign money needs government approval — and other income), is audited by the Auditor General, may not grant affiliation to other institutions, must follow national education and health policy and government directions, and must send an annual report to the government within three months of the end of the fiscal year. It makes its own rules, but rules that add to the government's financial burden need the government's approval. Nepal Law Commission, Government of Nepal Sections 28–31, p. 14; Section 36, p. 16; Sections 39 and 43, p. 17
Gaps, loopholes and improvement ideas
- Not enforced Allowances have been set without the government approval the Act requires. Section 43 requires government approval for rules that add to the government's financial burden. The Auditor General found that 53.36 per cent of the Academy's spending in 2081/82 depended on government grants, yet it paid officials, doctors and staff an academy allowance of 50 per cent of starting salary, remote-area allowances of 36–90 per cent, a non-practice allowance of 90 per cent for officials, and monthly communication, house rent and fuel facilities, without the government's prior approval. It asked the Academy to set standards and make the facilities uniform. Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Annual Report, MoHP chapter, Karnali Academy of Health Sciences para 70, printed pp. 545–546 (PDF pp. 577–578); Act s. 43, p. 17
- Capacity The Academy's hospital does not yet have some key equipment. The Auditor General reported that the 300-bed hospital has no MRI machine and no cardiac catheterisation lab; that its autoclave and oxygen plant had been out of use for three years (2080/81); and that in 2081/82 sixteen types of machines, including a ventilator and ultrasound, had been broken since the previous year. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd Annual Report, MoHP chapter, para 75, printed p. 599 (PDF p. 629); OAG 63rd Annual Report, MoHP chapter, para 69, printed p. 545 (PDF p. 577); Act s. 16, p. 11
Ideas to fix it
- Set standards for the allowances and facilities given to officials and staff so that they are uniform, and obtain the government's prior approval where they add to the government's financial burden. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
