What does it do?
- The Act makes caste-based and other social untouchability and discrimination a crime, whether justified by custom, tradition, religion or culture, or based on caste, descent, community, occupation or physical condition. Since a 2075 amendment it also spells out rights against such discrimination. These include equal treatment by courts, equal protection in government services, equal access to public services and public places, freedom of movement, residence and assembly, the right to marry a partner of one's choice, the right to choose work and get equal pay, and prompt remedy and compensation. Nepal Law Commission, Government of Nepal Preamble, p. 1; Sections 2ka and 3, p. 3
- Prohibited acts include barring people from entering or taking part in public or private places, expelling or socially boycotting them, and denying them public services or events. Also banned: restricting or forcing an occupation, keeping people from religious acts, refusing to sell goods or services to a caste (or selling only to one caste), and expelling family members from home or village because of caste. It is likewise an offence to stop or force the dissolution of an inter-caste marriage between consenting adults, spread material that ranks people as high or low by caste or justifies untouchability, or discriminate in hiring or pay. Nepal Law Commission, Government of Nepal Section 4(1)–(13), pp. 4–6
- Complaints go to the nearest police office. If police do not register or act on a complaint, it may be taken to the National Dalit Commission or the local level, which must forward it to police, who must then act. Cases are prosecuted by the State, must be filed within three months of the offence, and follow summary procedure. Investigators may seek help from local leaders, civil society or organisations working for the rights of affected people. Nepal Law Commission, Government of Nepal Sections 5–6, p. 6; Sections 10–12, p. 8

Gaps, loopholes and improvement ideas
- Not enforced Implementation needs strengthening. The UN Human Rights Committee (2014) welcomed the Act but was concerned at the lack of its effective implementation and the persistence of de facto discrimination against Dalits, and at insufficient resources for the National Dalit Commission. The UN CEDAW Committee (2018) likewise found the Act insufficiently implemented. In 2025 the CEDAW Committee noted that, despite national legislation prohibiting untouchability and caste discrimination, Dalit women and girls continue to face pervasive discrimination, sexual harassment and gender-based violence, and limited access to education, jobs, health care and benefits. UN Human Rights Committee · UN Committee on the Elimination of Discrimination against Women CCPR/C/NPL/CO/2, para 9, PDF p. 4; CEDAW/C/NPL/CO/6, para 40(b), PDF p. 15; CEDAW/C/NPL/CO/7, para 46(d), PDF p. 17
Ideas to fix it
- Strengthen measures to implement the Act, and ensure the National Dalit Commission has sufficient resources and that its recommendations are implemented. Proposed by: UN Human Rights Committee (2014); UN CEDAW Committee (2018) UN Human Rights Committee · UN Committee on the Elimination of Discrimination against Women
- Monitor and investigate reports of caste-based discrimination and untouchability, apply zero tolerance to discrimination against Dalit women, and increase Dalit women's representation in government and public bodies. Proposed by: UN CEDAW Committee (2025) UN Committee on the Elimination of Discrimination against Women
