What does it do?

  • The Act establishes the Nepal Music and Drama Academy, an autonomous body based in the Kathmandu Valley, to protect, promote and develop Nepal's music and theatre. It collects, researches and publishes on music and drama; preserves the instruments, folk tunes, dances and songs of Nepal's communities; sets up libraries, museums and theatres; offers training and fellowships; and honours artists with awards. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 3–5, PDF pp. 2–4
  • The Prime Minister is chief patron and the Culture Minister patron. The supreme body is an Academy Assembly of the Chancellor, Vice-Chancellor, the culture secretary and 24 eminent figures in music and theatre nominated by the Prime Minister with inclusive representation including women, for four-year terms; it must meet at least twice a year. An executive Academic Council of the Chancellor, Vice-Chancellor and six members (at least two women) runs the Academy. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 7, 10–11, 14–16, PDF pp. 4–9
  • The Academy has its own fund from government grants, other domestic and (with government approval) foreign sources, and fees for services. Its accounts follow the government system and are audited by the Auditor General, and it reports annually. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 26–27, 30, PDF pp. 12–13

Gaps, loopholes and improvement ideas

  • Not enforced Section 10(1) requires the Academy Assembly — which sets policy and approves the annual plan and budget — to meet at least twice a year, but the Auditor General found that it did not meet at all in FY 2081/82. The Academy had also lent Rs 8.84 million from its medical-treatment fund to 16 staff under its own 2080 loan procedure, none of which had been settled. Office of the Auditor General, Nepal · Nepal Law Commission (lawcommission.gov.np), consolidated text OAG 63rd report, Nepal Music and Drama Academy paras 54–55 (PDF p. 537, printed p. 505); Act Section 10(1), PDF p. 6
