What does it do?
- The Act re-establishes the Nepal Academy (founded in 2014 BS as the Nepali Sahitya Kala Academy) as an autonomous body, headquartered in the Kathmandu Valley, to protect, promote and develop all of Nepal's languages, literature, culture, philosophy and social sciences, recognising that Nepal is multi-ethnic, multilingual and multicultural. Nepal Law Commission, Government of Nepal Preamble and Section 3–4, pp. 1–3
- Its tasks include research and publication on all Nepal's languages, literature and culture, translation to and from foreign languages, encyclopaedias, dictionaries and new terminology, folk literature, the scripts and literature of different communities, priority protection of endangered languages and cultures, and honours and awards for contributors. Nepal Law Commission, Government of Nepal Section 5, pp. 3–5
- The Academy Assembly (Pragya Sabha), chaired by the Chancellor, is the top body; it includes 35 members nominated by the Prime Minister on the recommendation of a committee led by the Culture Minister, with inclusion and adequate representation of women, for four-year terms. It sets policy, approves the annual plan and budget and must meet at least twice a year. An Academic Council, a Chancellor, Vice-Chancellor and Secretary run day-to-day work, and a Service Commission recruits staff. Nepal Law Commission, Government of Nepal Sections 6–13, pp. 5–9; Sections 16–20 and 25, pp. 10–13
- The Academy has its own fund, its accounts are audited by the Auditor General, it must submit reports, and it deals with the government through the Ministry of Culture, Tourism and Civil Aviation. Nepal Law Commission, Government of Nepal Sections 26–27, 30 and 34, pp. 13–15
Gaps, loopholes and improvement ideas
- Capacity Pension costs consume most of the Academy's own income. Pension payments to 124 retirees in FY 2080/81 and 138 in FY 2081/82 (Rs 47.3 million) equalled 59% to 89% of its internal income over 2078/79–2081/82, so pensions were paid out of the government grant. The Auditor General recommended a contribution-based pension fund to reduce the long-term liability. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd Report, MoCTCA chapter, Nepal Academy para 51, printed p. 553; OAG 63rd Report, MoCTCA chapter, Nepal Academy para 57, printed p. 506
