- Each reporting institution's existing regulator (for example Nepal Rastra Bank for banks) supervises its compliance and can penalise it. A directive committee and a coordination committee set policy and coordinate agencies. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 7न–7फ, PDF pp. 35–41; Sections 7ब–7भ, PDF pp. 41–44; Sections 9–10, PDF pp. 45–47

Gaps, loopholes and improvement ideas
- Loophole Nepal is still working towards full compliance with international anti-money-laundering standards. According to the Asia/Pacific Group follow-up report of 13 June 2025 cited by the Auditor General, of 40 technical recommendations Nepal fully met 5, largely met 16, partly met 16 and did not meet 3. Areas only partly met include laws and rules on non-profit organisations, targeted financial sanctions for terrorism and proliferation financing, risks from new technologies, preventing misuse of legal persons, and regulation and supervision of financial institutions and non-financial businesses and professions. The OAG's 62nd report had recorded that recommendation 8 (non-profit organisations) was not met because the relevant laws and rules were inadequate. (Both reports predate the 2083 amendment.) Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd report, para 23 (PDF p. 124, printed p. 92); OAG 62nd report, para 27 (PDF p. 120, printed p. 90)
- Capacity A relatively small share of investigations reaches court. Since its establishment up to FY 2080/81 the Department of Money Laundering Investigation registered 4,083 complaints and filed 101 cases claiming Rs 14.27 billion; of the 308 complaints it investigated, only 101 became cases. The Auditor General said its investigation capacity should be strengthened through a risk-based approach and special coordination arrangements with reporting institutions, regulators, the Financial Information Unit and law-enforcement bodies. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd report, para 25 (PDF p. 119, printed p. 89); OAG 63rd report, para 22 (PDF p. 124, printed p. 92)
- Not enforced The government adopted a National Strategy and Action Plan against money laundering and terrorist financing (2076–2081) with 3 goals, 10 objectives and 30 strategies, but the Auditor General found that no progress report on it had been prepared. Office of the Auditor General, Nepal OAG 62nd report, para 26 (PDF p. 120, printed p. 90)
Ideas to fix it
- Make the legal and structural reforms needed in the areas the Asia/Pacific Group found only partly compliant, and strengthen investigation and prosecution skills, including by identifying new risk areas. Proposed by: Office of the Auditor General (62nd and 63rd Annual Reports) Office of the Auditor General, Nepal · Office of the Auditor General, Nepal
