What does it do?

  • The Act aims to give municipal areas regular, well-run, good-quality and affordable drinking water and sanitation. It lets the Government of Nepal, after consulting the municipalities, form a Water Supply Management Board by Gazette notice to run a system then operated by a government body or corporation in one or more municipalities. Parts of rural municipalities served by the same system can be included. A municipality can also apply to the government for a board. Each board is an autonomous corporate body. Nepal Law Commission, Government of Nepal Preamble, p. 1; Sections 3–4, pp. 3–4
  • Boards acquire, build, expand and rehabilitate water systems, make policies on their use, prevent misuse and pollution of drinking water, and plan and find finance. They also have tariffs fixed under the law, license service providers or contract them, collect tariffs and hear consumer complaints against providers. Each board is run by an executive committee made up of the mayors of the municipalities in its area, a water ministry representative, a rural municipality chair, and representatives of local business, consumers, NGOs and an expert. The committee meets at least six times a year, must act in the public interest, and appoints an executive director for five years. Nepal Law Commission, Government of Nepal Sections 6, 8, 10, 14, 16–17, pp. 5–12
  • A separate Kathmandu Valley Water Supply Management Board may be formed for the municipalities of Kathmandu Valley. It can take over the valley assets and liabilities of Nepal Water Supply Corporation and other government bodies, and must take over the Melamchi project's structures within one year of completion. It may divert water from outside its area (with reasonable payment to local bodies or users) and must run services only through service providers. Under a 2082 amendment it may also regulate or license groundwater extraction in its area and charge commercial and industrial users by volume. Nepal Law Commission, Government of Nepal Sections 7–8, pp. 6–8 (s. 7(8)(ga)–(gha) added by the Some Nepal Acts Amendment Act 2082)
  • Boards may suspend or cut off service for unpaid tariffs and charge extra fees for late payment. They can fine people for damaging infrastructure (up to Rs 50,000 plus the loss), polluting water (up to Rs 25,000), misusing the service (up to Rs 15,000 and disconnection), or tampering with meters or obstructing work (up to Rs 10,000); fines go into a consumer protection fund. Accounts are audited by a licensed auditor appointed by the committee, the government may inspect them, and an annual report must reach the government within three months of the fiscal year's end. Nepal Law Commission, Government of Nepal Sections 25–27, 29–30, 32, pp. 14–17

Gaps, loopholes and improvement ideas

  • Capacity The Kathmandu Valley board's audits are not yet up to date. The Auditor General's 62nd report, covering FY 2080/81, audited the board's accounts only up to 2079/80 and listed its 2080/81 audit as outstanding; the 63rd report again lists 2081/82 as outstanding. In the 2079/80 audit, the Auditor General found that the board had not booked Rs 88.4 million of interest due on Asian Development Bank loan repayments, so its financial statements did not present a true and fair picture. It also found no completion report for Rs 9.62 billion of pipeline assets capitalised from advances to the Project Implementation Directorate, so it could not confirm the money was spent on the intended work. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 62nd report, Ministry of Water Supply chapter, para 2, printed p. 283 (PDF p. 313); KVWSMB entry (2079/80), paras 3 and 5, printed pp. 712–713 (PDF pp. 746–747); OAG 63rd report, audit arrears table, item 14, printed p. 837 (PDF p. 879); Act s. 30, p. 16
