What does it do?
- The Act sets out who signs and authenticates key public documents and how. A bill passed by the Federal Parliament goes from the Parliament Secretariat to the President, signed by the Speaker or Chair of the House where it originated; once the President signs and dates it, it becomes an Act. Authentic copies go to the President's Office, the Office of the Prime Minister, the Parliament Secretariat and the Ministry of Law, Justice and Parliamentary Affairs, whose Secretary must publish the Act in the Nepal Gazette. Resolutions passed by Parliament are authenticated by the Speaker or Chair. Nepal Law Commission Sections 3–4, pp. 3–4
- An ordinance approved by the Council of Ministers is prepared by the Law Ministry and signed by the Prime Minister, the minister concerned, the Law Minister, the Chief Secretary and the Law Secretary before going to the President; once the President authenticates it, it has the force of an Act and is published in the Gazette. Orders, warrants and notices issued by the President are authenticated as provided by the Constitution and law, with copies sent for publication. Nepal Law Commission Sections 5–5A, pp. 4–5
- Rules, orders, warrants, directives and decisions of the Government of Nepal are authenticated by a secretary designated by the Council of Ministers and kept at the Office of the Prime Minister and the ministry concerned; other government documents are authenticated by the ministry secretary or a gazetted officer he designates. Rules and directives of constitutional bodies are authenticated by their heads; provinces and local levels follow their own laws. Authenticated documents are transferred to the National Archives after a set period and microfilmed. Nepal Law Commission Sections 6–13, pp. 5–7
- Forging a public document, authenticating something that did not happen, or altering an authenticated document is punished under the Muluki Criminal Code; attempting or abetting attracts half the penalty, and the offender must compensate anyone harmed. The Government of Nepal is the plaintiff in such cases. Nepal Law Commission Sections 14–15, pp. 7–8
