What does it do?

• The Act sets up the Nepal Law Commission to draft new laws, codify, consolidate, amend and review existing laws, and research law and justice. Its chair is someone who has served as or is qualified to be a Supreme Court justice; the vice-chair and up to three members (at least one a woman) are senior lawyers, judicial-service officers or legal scholars with 15 years' experience. All are appointed by the Government of Nepal on the recommendation of a committee led by the Law Minister, with the chair of the House's law committee and the president of the Nepal Bar Association. • Members must be Nepali citizens aged at least 45 with at least a law degree and no conviction for a crime involving moral turpitude. The chair and vice-chair serve five-year terms and other members two years; a post falls vacant at age 70. • The Commission prepares draft codes and bills with explanatory notes for the government; studies laws that are unused, contradictory, discriminatory, against human rights or unenforced and recommends repealing or amending them; checks whether laws match Supreme Court precedents; suggests how to bring treaty obligations into domestic law; and consults the public and other bodies on drafts.
