What does it do?

  • The Act regulates multimodal transport, where one operator carries goods under a single contract using more than one mode of transport, to strengthen Nepal's trading capacity. No one may run a multimodal transport service without a licence from the Department of Commerce. Only a company can apply, and it must have at least Rs 10 million paid-up capital, branches, authorised agents or representatives in at least two other countries, and the staff and facilities set by the rules. The Department must decide within 60 days; a licence costs Rs 25,000 and lasts five years, renewable. Nepal Law Commission, Government of Nepal Preamble, p. 1; Section 2(c)–(d), p. 2; Sections 3–4, pp. 3–4
  • A licence is cancelled if the company's paid-up capital falls below Rs 10 million, it no longer has representation in two foreign countries, or it fails to renew. For other breaches the Department must first give the operator time to correct the problem and a chance to explain. The company can appeal a cancellation to the Secretary of the Ministry of Industry, Commerce and Supplies within 35 days. Running a service without a licence can draw a fine of Rs 10,000–100,000 from the Department. Nepal Law Commission, Government of Nepal Sections 5–6, pp. 4–5; Section 28, p. 14
  • The operator issues a multimodal transport document, which may be negotiable, and is responsible for the goods from the time it takes charge of them until delivery. Goods not delivered within 90 days after the agreed delivery date are treated as lost. Unless the value was declared in the document, the operator's liability for loss or damage is capped at 666.67 Special Drawing Rights per package or 2 SDR per kilogram, whichever is higher (8.33 SDR per kilogram if the journey involved no sea or inland-waterway carriage), and never more than the total value of the goods. Nepal Law Commission, Government of Nepal Sections 7–11, pp. 5–7; Section 17, p. 9; Sections 20–22, pp. 11–12
  • Claims must be filed within six months of delivery, of the date delivery was due, or of the date the goods were treated as lost. If the consignee does not give notice of loss or damage in time, the goods are presumed to have been delivered in good condition. Nepal Law Commission, Government of Nepal Section 26, pp. 13–14; Section 29, p. 14
