What does it do?

  • The Act regulates the removal and transplantation of human organs for treatment under modern medicine and bans their use for other purposes. Health institutions need a government permit and doctors an individual licence to carry out transplant work; both can be suspended or cancelled, with appeal. Buying or selling organs, or doing transplant work for that purpose, is prohibited, and organs may be removed and transplanted only to treat disease. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 3–11, pp. 1–6; Sections 13–14, p. 11
  • A living donor must be a close relative of the patient (or, where relatives do not match, a member of another family in a written swap arrangement), aged at least 18, give voluntary written consent with relatives' agreement, and two doctors must certify both the patient's need and that the donor will not die or be permanently disabled; donors may withdraw consent without liability. Organs may be taken from a deceased person after brain death is declared by a medical team under set procedures, with the person's prior written consent or, failing that, a family member's — unless the person had refused in writing. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 12क–12ज, pp. 7–10; Sections 14क–16, pp. 11–13
  • An Organ Transplant Coordination Committee chaired by a senior doctor, with ministry, Medical Council and Medical Association representatives and the Director General of Health Services as member-secretary, prepares policy and programmes. Breaching the rules on brain death, consent, donors or organ trade is a crime punishable by up to five years' prison and a Rs 500,000 fine (more if done outside a health institution or without a licence); advertising organ sales is banned, inspections are allowed, and cases are prosecuted by the government. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 12, p. 6; Sections 23–28, 32, pp. 16–19
