What does it do?

  • The Act (2055 BS, i.e. 1998 AD) sets up the Greater Janakpur Area Development Council, an autonomous corporate body headquartered in Janakpurdham, to protect and develop the monasteries, temples, ponds and sites of religious, historical and archaeological importance in Janakpur and along its Madhyamiki (Panchakoshi) parikrama route — covering places such as Dhanusha Dham, Jaleshwar, Matihani and Dhruva Kunda — and to develop the area as a planned pilgrimage and tourist destination. Its objectives include building infrastructure, managing religious and cultural sites, researching heritage, and keeping environmental balance. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 2–5, pp. 1–4
  • A governing board, chaired by a person appointed by the government for four years, includes the chair of the Guthi Corporation, officials from the environment ministry and the archaeology and tourism departments, nationally known scholars, prominent people from Dhanusha and Mahottari, four saints, mahants or priests from the area, and rotating chairs of rural municipalities on the parikrama route; it approves plans and programmes and coordinates development work in the area. An executive committee — including the mayors of Janakpur and Jaleshwar and the Chief District Officers of both districts — implements them, covering drinking water, drainage, sanitation, greenery, building standards and tourism infrastructure. An executive director selected through open competition serves as administrative head for four years. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 6–11, 17, pp. 4–10, 12–13
  • The Council may, by public notice, regulate or ban activities in the area without its prior approval — such as using natural and heritage resources, settling or setting up markets in designated religious zones, polluting, using roads, bridges and water supplies, filming or advertising at religious or archaeological sites — and may declare protected sites. It can order unauthorised construction to be demolished within 35 days (doing so itself at the owner's cost if ignored, with the local government's help), and its orders can be appealed within 35 days (to the High Court since the 2073 change). The Council has its own fund (government grants, foreign aid or loans with government approval, local contributions, fees); it reports annually to the government and deals with it through the Ministry of Culture, Tourism and Civil Aviation. The Act replaced the 2049 order that formed the earlier development committee. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 13–16, 19–26, pp. 10–15
