What does it do?

  • The Act aims to protect public health by preventing adulteration of meat and keeping meat hygienic. It applies only in areas the government notifies in the Nepal Gazette: the note to the official text records it as in force from 15 Jestha 2065, and a 2060/01/08 notice applied it to a part of Hetauda Municipality. In those areas no one may set up a slaughterhouse or sell meat as a business without a licence from the designated authority. Nepal Law Commission, Government of Nepal Preamble and Section 1 with footnotes, p. 1; Section 3, p. 2; Section 5, p. 3; Note (Rashtavya), p. 7
  • The federal or a provincial government may establish slaughterhouses by notice and may license non-government slaughterhouses on prescribed conditions. Governments appoint meat inspectors with at least a bachelor's degree in veterinary science; provincial or local governments may designate meat supervisors to oversee slaughterhouses and inspectors. Inspectors and supervisors may enter slaughterhouses and meat shops at any time to inspect animals and meat and take samples. Nepal Law Commission, Government of Nepal Sections 4–7, pp. 2–3; Section 15, p. 5
  • Animals must be examined before slaughter and may be slaughtered only if passed by the meat inspector, in a slaughterhouse (or, where there is none, at the time and place the supervisor sets), and not on prohibited days. Meat is inspected after slaughter and must carry the inspector's stamp; diseased meat may be banned. It is prohibited to sell meat of animals not listed in the Act, of animals that died naturally, meat with skin (with exceptions for poultry, pigs and identifying parts), or meat mixed with other species or adulterated. Slaughter for festivals, religious worship and feasts outside slaughterhouses is allowed. Nepal Law Commission, Government of Nepal Sections 8–13, pp. 4–5; Section 16, p. 5
  • Breaches are punishable by fines (up to Rs 5,000 for a first offence and Rs 10,000 for repeat offences for inspection and stamping breaches; up to Rs 10,000 for a first offence and Rs 20,000 for repeat offences for operating without a licence, selling prohibited meat or adulteration) or imprisonment of up to one month or three months respectively, or both. Meat inspectors investigate offences, the State is the plaintiff, and cases are heard by the Chief District Officer, with appeal to the District Court. Nepal Law Commission, Government of Nepal Sections 17 and 19–21, p. 6
