What does it do?

  • The Act sets up the Town Development Fund (TDF) as an autonomous corporate body to give financial and technical support for building and expanding towns. It lends to and advises 'town development bodies' — metropolitan and sub-metropolitan cities, municipalities, town development committees, other government or non-government bodies doing urban land development, and selected urbanising villages — for basic services (roads, street lights, bridges, water, drainage, waste collection, public toilets, libraries, schools) and income-generating projects (markets, trade centres, bus parks, slaughterhouses, warehouses). Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble, p. 1; Sections 2–6, pp. 2–5
  • The Fund may raise money from the government, domestic and foreign bodies and international organisations (foreign loans need government approval), issue and buy debentures, invest in shares and bonds, and charge fees for advice. It lends against written conditions; if a borrower breaches them, it may recall the loan, take possession of and auction the collateral or other property, and it has first claim if a borrower body is dissolved. Its property transactions are exempt from registration fees. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 7–13, pp. 5–7; Section 23, p. 12
  • A board chaired by the secretary of the urban development ministry, with representatives of the finance and federal affairs ministries, seven mayors or deputy mayors (one per province, at least three women), finance or engineering experts and three inclusion-based experts, runs the Fund, with an executive director as member-secretary. Its accounts are audited by an auditor appointed after consulting the Auditor General, and the government may dissolve the Fund in specified circumstances. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 14, 18, 22, 33, pp. 7–14

Gaps, loopholes and improvement ideas

  • Not enforced The National Natural Resources and Fiscal Commission reports that in FY 2082/83, 17 local governments borrowed from the Town Development Fund without the federal consent that Section 14 of the Intergovernmental Fiscal Arrangement Act requires (the Ministry of Finance said none had asked), some borrowed outside their budgets, and Rangeli and Urlabari municipalities borrowed above the Commission's limit; the Auditor General likewise found 16 local governments raised Rs 37.19 crore from the Fund in FY 2081/82. National Natural Resources and Fiscal Commission · Office of the Auditor General, Nepal NNRFC 8th Annual Report s.7.4 tables, items 3–6, PDF pp. 299–300 (printed pp. 271–272); OAG 63rd report, NNRFC section para 5, PDF p. 105 (printed p. 73)
  • Loophole The NNRFC also found that when user committees and similar bodies borrow from the Town Development Fund, the local government where the project is located has stood as guarantor, although no law relating to local governments provides for this; it says no local government should act as guarantor without a legal basis. National Natural Resources and Fiscal Commission NNRFC 8th Annual Report s.7.4 suggestions, item 6, PDF p. 300 (printed p. 272)
