What does it do?
- The Act creates the Nepal Tourism Board as an autonomous corporate body, headquartered in the Kathmandu Valley, to establish Nepal internationally as an attractive, safe and reliable destination; develop and promote tourism while conserving natural and cultural heritage; raise national output and foreign-exchange earnings; and create jobs. Nepal Law Commission Preamble, p. 1; Sections 3–5, pp. 3–4
- The Board plans and implements programmes on tourism infrastructure, services, human resources and environmental protection at tourist sites; coordinates bodies that serve tourists; advises the government; may ask the government to act against tourism businesses that do not meet quality standards; and may invest in or buy shares of tourism companies. It may charge prescribed service fees for advice and services it gives to tourists and tourism businesses. Nepal Law Commission Section 6, pp. 4–7; Section 7, p. 7
- The Board is run by an executive committee chaired by the Secretary of the Ministry of Culture, Tourism and Civil Aviation, with a vice-chair chosen from among private-sector members, officials from the Finance Ministry, Immigration and the Civil Aviation Authority, and five tourism entrepreneurs or heritage experts nominated for three years on the recommendation of a nomination committee. The committee appoints a chief executive officer, who must have a master's degree and ten years' tourism experience, for a four-year term renewable once. Nepal Law Commission Sections 9–10, pp. 8–9; Section 14, p. 11
- The Board has its own fund made up of government grants, foreign and domestic aid, donations, contributions from the tourism industry and its service fees; it needs government approval before taking any foreign aid or loan. Its accounts are kept under the government accounting system and audited by the Auditor General or an auditor the Auditor General appoints. The chief executive must present an annual report to the committee within three months of the fiscal year-end, send it to the government and publish it. Nepal Law Commission Section 17, pp. 12–13; Section 18, p. 13; Section 21, p. 14
Gaps, loopholes and improvement ideas
- Not enforced Audits are several years from being up to date. Section 18 requires the Board to be audited by the Auditor General or an auditor it appoints, yet the Auditor General's 63rd report (2083) was still auditing the Board's accounts for 2070/71 to 2073/74 and stated that the Board had not had regular audits for the previous eight years. For 2070/71 the Board told auditors that records for 391 payment vouchers worth Rs 122.8 million and 441 other income, journal and purchase vouchers worth about Rs 186 million were lost, and that 732 payment vouchers worth Rs 193.8 million had been sent to the CIAA for investigation; for 2073/74 vouchers for Rs 118.6 million of transactions were not produced. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd Annual Report, Nepal Tourism Board (2073/74) paras 3 and 7, printed pp. 811–812 (PDF pp. 853–854); Nepal Tourism Board (2070/71) para 7, printed pp. 819–820 (PDF pp. 861–862); Act s. 18, p. 13
- Capacity Promotion — one of the Board's main jobs — needs strengthening. The High-Level Economic Reform Suggestion Commission (2081) found that tourism promotion is limited to a few road shows and that, for lack of budget and an effective action plan, Nepal's tourism marketing by the Board is 'almost zero'. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance · Nepal Law Commission HLERC report, tourism chapter, situation analysis item 10, printed p. 231 (PDF p. 298); Act ss. 5–6, pp. 3–7
Ideas to fix it
- The relevant ministry should act promptly to have the Board's accounts audited regularly; officials who did not keep or produce records should be held responsible and the missing transactions investigated. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
