What does it do?
- The Act sets up the Civil Aviation Authority of Nepal (CAAN), an autonomous body, to develop civil aviation and make flight operations, air communication, air navigation and air transport services safe, regular, standard and effective. CAAN both regulates and provides services: it issues, suspends and cancels operating permits and certificates for airlines, flight-training schools and maintenance organisations, licenses and rates pilots, engineers and other aviation personnel, recognises foreign licences, and also builds, runs and manages airports and air-navigation services. Nepal Law Commission Sections 3–6, pp. 4–9
- CAAN may regulate, restrict or give directions on lighting, buildings, trees and other obstacles in and around airports and flight paths, enter property and acquire land (with compensation) for its plans, raise money through loans, grants, charges and investments, restrict use of its services by those who do not pay, and form joint ventures with Government approval. It must operate on commercial principles. Nepal Law Commission Sections 7–12, 18, pp. 9–12, 15
- CAAN is governed by a board chaired by the Minister or Minister of State for Culture, Tourism and Civil Aviation (or a person the Government designates), with representatives of the Tourism and Finance ministries, a tourism-industry expert, a civil-aviation expert, two airline directors nominated by the Government, and the Director General as member-secretary. The Director General runs day-to-day operations, and airport security staff are provided. Nepal Law Commission Sections 13–21, pp. 12–17
- CAAN may fine people up to Rs 50,000 for doing regulated work without approval or against conditions, up to Rs 25,000 for disobeying its orders and up to Rs 10,000 for obstructing its work; dues are recoverable like government arrears. CAAN keeps its own fund and audited accounts, and the Government may give it directions. Nepal Law Commission Sections 23–25, 27, 29, 33, pp. 17–20
Gaps, loopholes and improvement ideas
- Capacity The High-Level Economic Reform Commission noted that the European Union has long kept Nepal's civil aviation sector on its air-safety list, so Nepali airlines cannot fly to European cities. Although ICAO removed Nepal from its Significant Safety Concern list in July 2017 after improvements, the EU listing has continued, which the Commission said deters tourists. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance HLERC report, tourism chapter ('हवाई क्षेत्रको कालोसूची'), printed p. 232 (PDF p. 299)
Ideas to fix it
- As a precondition for getting Nepal off the EU air-safety list, the High-Level Economic Reform Commission recommended separating the regulatory body and the service-providing body that are now combined in the Civil Aviation Authority of Nepal, and strengthening Nepali airlines' operations, finances, technical capacity and service quality. Proposed by: High-Level Economic Reform Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
