What does it do?

  • The Act establishes Purwanchal University, with its central office at Gothgaun in Sundar Haraicha Municipality, Morang, to run higher-education institutions in arts, science, law, management, education, technical and other subjects. Its stated aim is to raise the quality of education on a competitive basis, mainly through institutions run at the community level. Nepal Law Commission Preamble, p. 1; Section 3, pp. 2–3
  • The university consists of an Assembly (Sabha), Academic Council, Executive Council, Resource Council, campuses, faculties, a Service Commission and other bodies. The Assembly, chaired by the Chancellor, is the supreme body: it sets policy, manages campus establishment and affiliation, sets and awards degrees, approves the annual budget and programme and passes rules. Its members include the local first-past-the-post federal and provincial lawmakers, secretaries of the Education and Finance ministries, a National Planning Commission member, five scholars including at least two women, and the mayor and deputy mayor of the host municipality. Nepal Law Commission Sections 5 and 7, pp. 3–5; Section 9, pp. 5–6
  • The Prime Minister is Chancellor and may inspect and direct the university; the Education Minister is Pro-Chancellor. The Chancellor appoints the full-time Vice-Chancellor for four years on the recommendation of a committee chaired by the Pro-Chancellor. The Executive Council, chaired by the Vice-Chancellor with two deans, one teacher and the Registrar, is the executive body. Nepal Law Commission Section 12, pp. 7–8; Sections 22–24, pp. 10–11
  • The university has its own fund of government grants, donations, business and local-government contributions, fees and foreign assistance or loans; it needs government approval before receiving money from international or foreign sources. Accounts are kept under prevailing law and audited by the Auditor General. Nepal Law Commission Sections 31–32, pp. 13–14

Gaps, loopholes and improvement ideas

  • Not enforced Spending has bypassed the Assembly. Section 9 gives the Assembly the power to approve the annual budget and programme, but the Auditor General found that in 2081/82 the Executive Council decided on and spent allowances and benefits without Assembly approval — Rs 2.876 million for house rent, Rs 1.18 million as a ten-day-salary incentive for convocation staff and Rs 43.184 million for an official-perks liability. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd Annual Report, Ministry of Education chapter, Purwanchal University para 72, printed p. 451 (PDF p. 483); Act s. 9, pp. 5–6
  • Capacity Staffing is not based on need, and many programmes are under-used. Section 5 sets out the university's organisation, but the Auditor General found it had never carried out an organisation and management survey of its units: of 1,071 approved posts (315 academic, 756 administrative) 620 were vacant. In 2081/82 its nine constituent campuses admitted 1,010 students against a quota of 1,836 (55%), some programmes admitted no one, and the average teacher–student ratio was 1:7 (a population centre had five teachers and no students). The university had also issued five procedures without delegated authority under the Act. Office of the Auditor General, Nepal · Nepal Law Commission OAG 63rd Annual Report, Ministry of Education chapter, para 22, printed p. 433 (PDF p. 465); Purwanchal University paras 73, 74 and 78, printed pp. 451–452 (PDF pp. 483–484); Act s. 5, p. 3

Ideas to fix it

  • Control spending on allowances and benefits that the Assembly has not approved; carry out an organisation and management survey and set teacher and staff posts on the basis of workload and student numbers; review admission quotas and fees and develop courses and a strategy to attract students; and survey and fence the 805 bigha of land the government allotted in Morang. Proposed by: Office of the Auditor General (62nd and 63rd Annual Reports) Office of the Auditor General, Nepal · Office of the Auditor General, Nepal
