What does it do?

  • The Act regulates radio and television broadcasting. The Government of Nepal sets policy on supervising and running broadcasting programmes, and no one may broadcast any programme without a licence under the Act. Anyone wanting to broadcast by satellite, cable or other means, or to set up an FM broadcasting system, applies to the government, which may grant a licence with conditions; setting up a satellite uplink station for satellite or cable television needs separate approval. Government-owned bodies set up before the Act are deemed licensed. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 3–6, 9, PDF pp. 4–6; Section 23, PDF p. 10
  • Since a 2075 amendment, licensing, renewal and regulation of FM radio up to 100 watts fall under local government law within that local area, and of FM radio from 100 to 1,000 watts and cable-based television under provincial law within that province; until those laws are made, this Act and its regulations apply. Provinces and local governments must ask the ministry for frequency allocation. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 3क, PDF p. 4
  • Broadcasters must give priority to development, social harmony, languages and cultures, national unity and democratic values, and must not broadcast material harming relations with neighbouring and friendly countries. Advertisements against political parties, obscene material, material aimed at violently overthrowing an elected government, material spreading fear, or material insulting any caste, language, religion or culture are banned. Broadcasters must check facts, be politically impartial, present controversial issues from all angles and avoid false or misleading news; they must not broadcast character assassination or content promoting gender violence or discrimination. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 11, 15–16, PDF pp. 6–9
  • The government may, by notice in the Nepal Gazette and for up to six months at a time, bar broadcasting of programmes on a particular subject, event or area in the national interest. Section 8, which let the government cancel the licence of a broadcaster that breached the Act or its rules, was declared void by the Supreme Court on 2070-09-25 (Advocate Rajiv Bastola v. Office of the Prime Minister and Council of Ministers, writ no. 069-WS-0025), as the Law Commission's footnote to both subsections records. Broadcasting without a licence is punishable by a fine equal to the fees due or up to one year in prison or both; other breaches by a fine of up to Rs 10,000 or up to one year in prison or both, with appeal to the High Court within 35 days. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 7–8 and footnote on Section 8, PDF p. 5; Sections 17–18, PDF p. 9
