What does it do?
- No foreigner may enter or stay in Nepal without a passport and a visa. Visa types and fees, and the entry and exit points foreigners must use, are set by regulation. - The Department of Immigration, headed by a Director General, regulates the entry, stay and departure of foreigners, issues and extends visas and trekking permits and may cancel them, and also manages the arrival and departure of Nepali citizens. - Using a false passport or visa, giving false details about name, age or nationality, or bringing in a foreigner who has no valid passport and visa is an offence punishable by a fine of up to Rs 50,000, up to five years in prison, or both. - After an investigation, the Director General may, with government approval, deport a foreigner and bar re-entry for a set or indefinite period; re-entering during that period is punishable. The Director General can also fine other breaches of the Act up to Rs 50,000 (appealable to the High Court within 35 days). Gaps, loopholes and improvement ideas
- Capacity The Act gives the Department of Immigration the job of managing Nepali citizens' departures (Section 7(घ)), but the Auditor General found that 261,551 Nepalis (149,789 men and 111,762 women) left on visit visas in FY 2081/82, and that in a sample of 12 such travellers, 9 had not returned; one had travelled abroad 10 times since 2020. - Capacity The Auditor General found gaps in record-keeping for visa stickers. For FY 2078/79–2080/81, 2,289 rolls of visa stickers were printed and 1,925 rolls sent to offices and the Ministry of Foreign Affairs, but the offices kept no records and the ministry did not send monthly reports of visas issued (OAG 62nd report).
