Press Council Act 2048 (1992)

What does it do?

• The Act sets up the Press Council Nepal as an autonomous body to develop healthy, independent and accountable journalism. Its aims are to create a good environment for journalism, set a code of conduct so press freedom is not misused, keep cordial relations between the press and the government, uphold public morality and citizens' dignity, and resist interference with press freedom.स्वस्थ, स्वतन्त्र र उत्तरदायी पत्रकारिताको विकासका लागि प्रेस काउन्सिल नेपाल स्वशासित संस्थाका रूपमा स्थापना गरिएको छ। पत्रकारिताका लागि उपयुक्त वातावरण बनाउने, प्रेस स्वतन्त्रताको दुरुपयोग नहोस् भनी आचारसंहिता तोक्ने, प्रेस र सरकारबीच सौहार्द कायम राख्ने, सार्वजनिक नैतिकता र नागरिकको मर्यादा कायम गराउने, र प्रेस स्वतन्त्रतामाथि हस्तक्षेप हुन नदिन प्रयत्न गर्ने यसका उद्देश्य हुन्। Nepal Law Commission, Government of Nepal Sections 3–5, pp. 2–3
• The government forms the Council: a chair nominated from retired Supreme Court justices, senior advocates or distinguished journalists; the president of the Federation of Nepali Journalists; six journalists, editors and publishers (two from each group) nominated after consulting journalists' associations; one working journalist; one other distinguished person; one literary journalist; and the Director General of the Department of Information as member-secretary. • The Council advises the government on media policy, sets and enforces the journalists' code of conduct, keeps records on newspaper circulation and reports annually on the state of the press. • Anyone may complain to the Council that a journalist breached the code of conduct. After giving the journalist a chance to explain, the Council may order publication of the complainant's response, an apology or a correction, and may recommend that repeat violators lose government facilities for a period; if a journalist ignores its decision, the Council may publicly express regret.
