What does it do?
- The Act governs how Nepal signs, ratifies, accedes to, accepts or approves treaties (any written agreement between states, or between a state and an intergovernmental organisation, whatever it is called). Only the President, the Prime Minister or the Foreign Minister may negotiate, adopt or sign a treaty, or enter a reservation, on Nepal's behalf without 'full powers' issued by the government; ambassadors and conference delegation leaders may negotiate and adopt texts within their remit. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 2(क)–(ख), pp. 1–2; Section 3, p. 2
- Treaties on the subjects listed in Article 279(2) of the Constitution must be ratified by the Federal Parliament under that Article. Other treaties that require ratification, or by which Nepal joins or establishes an intergovernmental organisation, or that are contrary to existing law, must be approved by a majority of members present in the House of Representatives. All other treaties take effect once signed by decision of the government, and must be reported to the House within one month of its next sitting. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 4–6, pp. 3–4; Section 10, p. 5
- Where a treaty ratified, acceded to, accepted or approved by Parliament conflicts with existing law, the conflicting law is void to that extent and the treaty applies as Nepal law. If a treaty not approved by Parliament places new obligations on Nepal that need legislation, the government must start making that law as soon as possible. Treaties do not apply retroactively unless they say so. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 8–9, p. 4
- The government may withdraw from or suspend a treaty, informing Parliament (or the House) depending on the kind of treaty. Treaties approved by Parliament must be published in the Nepal Gazette within 60 days of approval; other treaties are published, and registered with the UN Secretariat or other bodies, as the government thinks fit. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 7, p. 4; Sections 11–12, p. 5
