What does it do?

  • The Act establishes the Nepal Water Supply Corporation as an autonomous corporate body, headquartered in the Kathmandu Valley, for areas the Government designates by notice. It plans, builds and runs drinking-water and sewerage systems, protects water sources and the routes from source to distribution, carries out research and surveys, implements agreements with foreign and international bodies and Government-assigned projects, and provides water and sewerage services for a fee while covering its own operating costs. Nepal Law Commission Sections 3–5, pp. 3–4
  • With Government approval, the Corporation may contract out a service system it runs, together with its structures and equipment, to a body at least 80 percent owned by the Government and local bodies, a non-profit body or a users' organisation; staff may be seconded to the contractor or redeployed or retired with benefits. The Government may also transfer ownership of a service area's system, with matching liabilities, to a water management board (as was done for the Kathmandu Valley). Nepal Law Commission Sections 5A–5D, pp. 4–7
  • The Corporation collects water tariffs and charges for sewerage and connections, sets payment deadlines, adds a 25–50 percent surcharge for late payment, and may cut off service for unpaid dues until they are cleared. Its staff may enter property to lay and repair pipes. A board chaired by a Government appointee experienced in water management, with ministry representatives, a mayor of a served municipality, two women from consumer organisations and a water-quality expert, manages it. Nepal Law Commission Sections 6–8, 11, pp. 7–10
  • Damaging the Corporation's systems, tampering with or stealing water, and other prohibited acts are offences: the most serious carry recovery of the loss plus a fine of up to Rs 10,000 and/or up to five years' imprisonment, others up to three years and/or Rs 30,000, and the Corporation itself may impose smaller fines for minor breaches. Nepal Law Commission Sections 18–19, pp. 13–14
